Terms of Use

These terms form an agreement between you and Flom Ventures AS ("we", "us"), a company registered in Norway, covering your use of the Kaddie app. By downloading or using Kaddie you accept them. If you do not accept them, do not use the app.

1. Who may use Kaddie

You must be at least 13 years old, and old enough to agree to a contract where you live. If you are under the age of majority, you may only use Kaddie with the involvement of a parent or guardian. You must also comply with the Apple Media Services Terms and Conditions.

2. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Kaddie on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not: copy or redistribute the app; sell, rent or sublicense it; reverse-engineer, decompile or attempt to derive its source code; remove proprietary notices; or use it to build a competing product.

3. Your content stays yours

The videos you import and the traces you create are your content. We claim no ownership of them, and we do not acquire any right to use them merely because you used the app. You are responsible for having the rights necessary to film, import and use your footage, including the rights of any person appearing in it and any third-party material it contains.

4. Featured clips — the licence you grant if you submit

Kaddie contains an optional screen called "Feature my shot". Nothing in this section applies unless you deliberately submit a specific clip through that screen and tick both consent boxes.

4.1 What you grant us

When you submit a clip, you grant us a non-exclusive, worldwide, royalty-free, fully paid, sublicensable licence to host, store, reproduce, edit, adapt, crop, re-time, add captions, graphics or music to, publicly display, distribute and perform that clip and any part of it, for the purpose of marketing and promoting Kaddie, including on our website and social media channels and in paid advertising.

The sublicence exists because advertising platforms (for example Meta, TikTok, Google and YouTube) require a licence to host and serve any material placed with them. It is limited to that purpose. We will not sell your clip to third parties for their own unrelated use.

4.2 What you promise us

By submitting a clip you represent and warrant that:

Music is the trap most people miss. If a song is playing in the background of your clip, publishing it can trigger a copyright claim. Please do not submit clips with recorded music in them.

4.3 Indemnity

You agree to indemnify and hold us harmless from any third-party claim, demand, loss, liability or reasonable legal cost arising out of a breach of the promises in section 4.2 — for example a claim by someone appearing in a clip who had not in fact agreed, or by a rights holder whose music or footage was included. This is limited to claims caused by content you submitted, and does not apply to the extent the claim results from our own unlawful act or from changes we made to the clip beyond the licence above.

4.4 Withdrawing a clip, and the honest limits

You may withdraw a submitted clip at any time in the app under Settings → "Remove my featured clips", or by emailing privacy@kaddie.net. On withdrawal we will:

We must be straightforward about what withdrawal cannot do. Once something has been published on the internet, we cannot guarantee removal of copies that other people made — reshares, screenshots, downloads, archives, embeds, or copies cached by advertising platforms and search engines. Advertising creatives already in flight may take a short time to stop serving. We will take reasonable steps; we cannot promise erasure from the internet.

4.5 Credit, and no payment

We will credit you using the handle you gave, where the format allows, but credit is not guaranteed by every platform or ad format. You are not entitled to any payment, royalty or other compensation for a submitted clip, and submitting one does not create an employment, agency or partnership relationship. We are not obliged to use a submitted clip at all.

4.6 Reporting a clip

If you appear in a clip we have published and did not agree to it, or you hold rights in material within it, contact abuse@kaddie.net or use the reporting option in the app. We will review promptly and remove content where a report is substantiated.

6. Acceptable use

Do not use Kaddie to break the law; to upload content you have no right to use; to submit material that is abusive, harassing, hateful, sexual, or infringing; to attempt to gain unauthorised access to our systems; to interfere with or overload the service; or to use automated means to scrape or abuse it. We may remove content, suspend access, or terminate your use where these terms are breached.

7. Accuracy — please do not rely on the numbers

Kaddie estimates ball flight from ordinary phone video. Distances, speeds, apex heights, launch angles and flight times shown are approximations for entertainment, produced from a single camera without calibration. They are not measurements. Do not rely on them for competition, handicapping, wagering, equipment purchases, coaching decisions or any other purpose where accuracy matters.

7b. AI swing analysis — coaching for entertainment, not professional instruction

Kaddie can also analyse a golf swing and return written coaching feedback. This feature is provided for general information and entertainment. It is not professional golf instruction, and it is not medical, physiotherapy, fitness or health advice.

8. The service, and what we do not promise

We work to keep Kaddie available and improving, but we do not promise it will be uninterrupted, error-free, or that any particular feature will remain. Automatic tracing depends entirely on the quality of the footage you provide — lighting, camera angle, resolution, stability and background all affect it, and it will not succeed on every clip. Manual tracing is provided precisely because automatic detection has limits. AI swing analysis likewise depends on the footage and on a third-party AI service we do not control, and may be unavailable or return no useful result. Features may be added, changed or withdrawn.

9. Our intellectual property

Kaddie — including its name, logo, software, algorithms, designs, and the look of the tracer graphics — is owned by us and protected by law. These terms transfer nothing to you beyond the licence in section 2. Feedback you send us may be used freely without obligation to you.

10. Disclaimer of warranties

To the fullest extent permitted by law, Kaddie is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost content, arising from your use of Kaddie. Our total aggregate liability arising out of or relating to the app is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) EUR 50.

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or for a consumer's mandatory statutory rights.

12. Indemnity

Beyond section 4.3, you agree to indemnify us against claims arising from your unlawful use of the app or your breach of these terms.

13. Suspension and termination

You may stop using Kaddie at any time by deleting it (remember to cancel any subscription separately through Apple). We may suspend or terminate access where you materially breach these terms, where required by law, or where continuing would expose us to liability. Sections that by their nature should survive termination — including sections 3, 4, 9, 10, 11, 12 and 16 — survive it.

15. Assignment

You may not assign or transfer these terms. We may assign or transfer them, together with the rights and licences granted under them, to an affiliate or in connection with a merger, acquisition, reorganisation or sale of all or substantially all of our assets, on notice to you.

16. Governing law and disputes

These terms are governed by the laws of Norway, and the Norwegian courts have jurisdiction. If you are a consumer resident in the EU/EEA, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings there. Consumers in the EU may also use the European Commission's online dispute resolution platform.

17. General

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us about the app.

18. Changes

We may update these terms. The version and date at the top will change, and continued use after an update means you accept the revised terms. Where a change materially affects a licence you granted us, it will not apply retroactively to clips you already submitted.
